Additional Arrest In Hempstead Drive-By Shooting That Killed Mom In Front of 10-Year-Old Daughter

In November of last year, Oumar Barry, 27 of Hempstead (left), along with a 16-year-old male juvenile, were arrested and charged with second-degree murder. Added to the list of arrests is Milton Allen, 20-year-old also of in Hempstead. Homicide Detectives also charged him with second-degree murder. Allen was expected to be arraigned today, Tuesday, January 23, 2024, at the First District Court, in Hempstead.

HEMPSTEAD, NY – Since last April, the Nassau County Homicide Squad has been investigating an incident of attempted murder that took place in the community of Hempstead. The incident occurred in the early hours of Saturday, April 1, 2023, at approximately 1:30 AM on Polk Avenue.

At that time upon receiving a ShotSpotter activation, Hempstead Police Officers responded to the scene where they discovered two female victims, each bearing the unmistakable marks of gunshot wounds.

The victims were transported to nearby hospitals for immediate treatment. One victim was initially listed as stable and later released, while the other, Kimberly Midgette, 44, was in critical condition and later succumbed to her injuries.

Midgette, was shot in her Toyota Corolla while her 10-year-old daughter was in the backseat, according to Nassau County District Attorney Anne Donnelly.

On November 2, 2023, two suspects were apprehended in connection with the crime. Oumar Barry, a 27-year-old resident of Terrace Avenue in Hempstead, along with a 16-year-old male juvenile. Both were charged with one count of second-degree murder, one count of second-degree attempted murder, one count of first-degree assault, and two counts of second-degree criminal possession of a weapon.

On Monday, detectives added to the list of arrests with Milton Allen, a 20-year-old man residing on Grove Street in Hempstead. Homicide Squad Detectives have also charged him with second-degree murder. Allen was expected to be arraigned today, Tuesday, January 23, 2024, at the First District Court, in Hempstead.
